Abstract

This is a tranlsation of the Giaolong code of 1812, which in fact reproduces the Qianlong Da Qing lüli of 1740 with just a few changes . Philastre's translation is not only integral and faithful, it is also finely argued and documented, with large pieces of the best commentaries (i.e. Dulü peixi 讀律佩攜; Lüli bianlan 律例便覽) translated. The major impediment is that no Chinese characters are provided, and that the legal terms, when transcribed, adopt the Vietnamese pronounciation. Moreover, even though very few articles of the Chinese codes are missing, this is enough to give a different numeration than with modern translation (say by Jones, or Jiang Yonglin). Philastre translates all the substatutes borrowed from the 1740 Da Qing lüli in the Gialong code, and summarizes those that have not been included. As a Navy  officer acting as "Commissaire des affaires indigènes", Philastre endeavored to use French civil law words and concepts in his translation, as visible right from the sections headings: "Lois civiles", for Hubu 戶部 section, for instanc (more literally translated Section on Revenus, or on Households), a section where the civil law terms are the most employed. While this bias shoul not be overlooked, Philastre's careful discussions and refined arguments, his true understanding and interest (or even sympathy) for this unwestern form of legal codification allows his to be the most complete and accurate translation of the Qing code available.
